A DUI defendant can make the argument that the defendant was not legally drunk at the time of the stop. He can argue that he was not driving when his blood finally rose to a .08 or higher. The prosecutor will argue just the opposite, that the blood level of alcohol was lowering and that is why you tested at less than a .08. Thus the argument is made that the blood-alcohol concentration was falling at the time of testing – and, therefore, that the level was higher at the time of driving. Even then, the argument by the prosecutor that the DUI defendant’s blood alcohol (BAC) was falling is not scientifically sound to support greater impairment. At least one DUI expert concludes that alcohol impairment is worst when the blood is rising and not falling. So faling blood means less impairment. Keith Roane’s DWI arrest While Not Driving and Not Drunk

This is at the very most a “MIC” Minor in consumption as I, the defendant, was not driving. My attorney advised me to have a trial by judge. I used the law offices of Chris Hoover and lost! Upon appeal I discovered that my attorney never filed a “Notice of Appeal” and so the Notice was less then 15 days late and only needed rule 26.3 Extension Motion. As a Student and a person qualified for a court appointed attorney, the judge denied my request for court appointed attorney even though I qualify because of my low income. NEED HELP WITH APPEAL 1 – The cop lied about the girls age – she was 21 not 16 – this was admitted in court and in the transcript. 2 – Cop failed to turn off his emergency lights for HGN test. 3 – I admitted to driving – I never said when I drove 4 – I had not drunk anything until after I drove – the driving came first so I was sober when I was driving and I did the tests just fine – The cop said so himself in the video 5 – I was inside drinking at my friend’s house when the cops arrived. 6 – In trial the prosecutor never once used the words DWI in trial.michigan drunk driving laws

A first and second time Michigan drunk driving offense are both misdemeanors as well as a “zero tolerance” for underage drinking and driving. A first offense with a minor child in the car is also a misdemeanor. The penalties for OWI (which stands for operating while intoxicated) or the lesser included offense of operating while impaired range from no jail for a zero tolerance violation to 93 days in jail for OWI or OWVI 1st and up to one year for OWI 2nd. A second offense within 7 years carries a mandatory five days in jail.

A second offense with a minor child in the car a third drunk driving conviction within 10 years or a drunk driving accident involving serious injuries or a fatality are felonies. The penalties with these felonies range from as little as 30 days in jail up to 20 years.

Your best bet is to hire an attorney from the National College for DUI Defense if you can afford to do so. At last count there were ten in the state but they are amongst the best drunk driving defense attorneys around. Arizona DUI Cops

The drug was prescribed by my doctor and he said it was safe to drive with it. But the drug made me tired and I pulled over to the side of the road to rest. The police came over and charged me with being under the influence of drugs.

“SAN FRANCISCO – The California Supreme Court on Wednesday upheld the one-year driver’s license suspension handed to a 16-year-old motorist police pulled over after she allegedly ingested a capful of cough medicine to battle a cold.

The justices upheld a 1993 California law in which motorists under 21 automatically lose driving privileges for a year even if a trace amount of alcohol is detected in their blood. The outcome also clarified for the first time that the source of alcohol does not have to be adult beverages.

The motorist’s attorney argued that the zero-tolerance law was aimed at minors drinking alcoholic beverages not those legitimately taking cough syrup — in this case allegedly a small amount of cough medicine that was 26 percent alcohol.

”It is our position the Legislature never intended to yank a kid’s license for a year simply for taking a normal dose of cough medicine for a cold” said Paul Burgin the attorney for Karli Bobus a Novato girl who was 16 when pulled over in 2002.

An appeals court while questioning whether Bobus was telling the truth about what she drank upheld Bobus’ license suspension in January. The 1st District Court of Appeal in San Francisco ruled that ”a minor can maim or kill if they drank cough syrup or if they drank beer.”

Bobus appealed that decision to California’s seven justices who upheld the suspension without comment.

The California Highway Patrol reported that Bobus now 18 measured a 0.022 percent blood-alcohol level the equivalent of roughly one beer’s worth of alcohol.

The CHP said she was swerving and stuttering. She was not prosecuted for drunken driving which usually requires a blood-alcohol level of about 0.08 percent.

Citing the appellate court’s ruling state prosecutors urged the Supreme Court to uphold Bobus’ license suspension.

”The Supreme Court considered the appeals court opinion and decided it was well written and correct” said Deputy Attorney General Raymond Hamilton.

Burgin meanwhile said Bobus’ automobile insurance rates have skyrocketed.

Under the appellate court’s decision Burgin said it could logically be argued that minors could be charged for illegally possessing alcohol simply by having a bottle of cough medicine and that adults could violate open container laws when driving with an opened bottle of cough medicine.

The case is Bobus v. Department of Motor Vehicles S131323.”

If I am able to die for this country at the age of 18 then I should be able to drink a glass of wine. I am not talking about getting drink and driving a car I am talking about walking to the bar and ordering a beer.
I am an individual and not a statistic

Because there are liberals who want to control everything you do and the irrational religious groups that think because it feels good its a sin and we must make laws against sin ( never figured out why either of them dont shut up and mind their business I dont tell them not to drink soda). And because alot of young people are stupid they think that the only point of alcohol is to get drunk (alot of Americans over 21 think like that unfortunately we are a great country but we have the largest amount of idiots IMHO). It should be lowered and I believe that would cut down on alot of drinking deaths. Its also the fact that all politicians are over 21 and just want to stick it to young people (alot of older people hate young people for some reason).

I got a question for you guys to just think over though. Why is the penalty for underage drinking harsher than the penalty for DUI (my state the menalty for minor in possession is 6 months in jail and the penalty for drunk driving is 72 hours in jail for the first offense)
