www.ehlinelaw.com 888.400.9721 toll free: The absorptive phase of alcohol ingestion is completed before the time of testing is the major presumption of the Breathalyzer machine. A DUI defendant can make the argument that the defendant was not legally drunk at the time of the stop. He can argue that he was not driving when his blood finally rose to a .08 or higher. The prosecutor will argue just the opposite, that the blood level of alcohol was lowering and that is why you tested at less than a .08. Thus the argument is made that the blood-alcohol concentration was falling at the time of testing – and, therefore, that the level was higher at the time of driving. Even then, the argument by the prosecutor that the DUI defendant’s blood alcohol (BAC) was falling is not scientifically sound to support greater impairment. At least one DUI expert concludes that alcohol impairment is worst when the blood is rising and not falling. So faling blood means less impairment. But you need expert DUI attorneys to make this happen and get the right experts should the case need to be tried. If I am able to die for this country at the age of 18 then I should be able to drink a glass of wine. I am not talking about getting drink and driving a car I am talking about walking to the bar and ordering a beer.
I am an individual and not a statistic
Because there are liberals who want to control everything you do and the irrational religious groups that think because it feels good its a sin and we must make laws against sin ( never figured out why either of them dont shut up and mind their business I dont tell them not to drink soda). And because alot of young people are stupid they think that the only point of alcohol is to get drunk (alot of Americans over 21 think like that unfortunately we are a great country but we have the largest amount of idiots IMHO). It should be lowered and I believe that would cut down on alot of drinking deaths. Its also the fact that all politicians are over 21 and just want to stick it to young people (alot of older people hate young people for some reason).
I got a question for you guys to just think over though. Why is the penalty for underage drinking harsher than the penalty for DUI (my state the menalty for minor in possession is 6 months in jail and the penalty for drunk driving is 72 hours in jail for the first offense)

The criminal justice system is made up of three interdependent agencies (police courts and corrections) just like the United States government (executive legislative and judicial branches). Much like in the criminal justice system one branch of government cannot function effectively without the function of the other branches. Why is it important in both the criminal justice system and the government that the power of law is divided among three different bodies of people Do you think it is effective and efficient to spread the decision-making and participants among so many people
The idea that each part of the whole provides checks and balances for the others is great. The founders of our Nation were inspired to create such a system. And if it was continually run by honest men who did not seek power and control over others it would be an efficient and magnificent system where true justice and equality would be the result. It would be a system worthy of the respect of all.
However the gross inefficiency of the criminal justice system and the overly developed sense of partisanship with each part of the system vying for control of the others and politicians making back room deals lobbying and promoting personal agendas over the good of the people … well you get the picture. It certainly shows that our system is breaking down. I think it can safely be said that when the wheels of justice turn so slowly that hardened offenders have opportunity to commit heinous crimes over and over before justice is served and elected & appointed officials turn their backs on the principles of Truth Freedom Equality for all in order to continue their reigns of power …when that happens it can safely be said the checks and balances are no longer working.

I was just wondering how defense lawyers win drunk driving cases especially with a video it is fairly easy to tell a drunk person from a not drunk person I think….
Well the simplest reason is that DUI cases are pretty complex on the law enforcement end. There are a lot of steps of officer most perform to be in compliance with the federal training on the issue. If the officer misses a step screws up the instructions (even a minor mistake such as forgetting a word or two) can give a defense attorney room to attack.
Now most state courts (and federal courts) have ruled as long as the officer is reasonably close in the instructions given and how the test is performed then it should be good to go. But the problem is also prosecutors.
In cities under 100000 (or even smaller counties) prosecutors may be only part time and work in private practice full time. So they might not have the time energy or willpower to full research and prosecute a DUI case. They may have no clue what the defense attorney is talking about and aren’t able to get back the evidence a defense attorney chips away at.
Lastly a lot of DUI cases are made by inexperienced officers officers who don’t care much for DUIs or officers that don’t do a lot of DUIs. If an officer is on dayshift for the last 4 years then works a nightshift and lands his first drunk in literally years…. He probably isn’t going to be spot on with his field sobriety tests.
So *shrugs* it is just the nature of the beast. When you have defense attorneys who don’t do anything except study the NFTSA manual on HGN and make a lot of money taking DUIs to court you might see them win a lot of cases.
Now the good news….. In my experience many cities have good officers and prosecutors that actually know their stuff and can win cases. So while it may seem like *a lot* of people get off the hook on their drunk driving charges a lot more are successfully prosecuted.
