My boyfriend got a DUI careless driving and racing on highways his alcohol leve was .105%. I know he was wrong so I don’t need anyone giving a lecture I just need help from anyone who has been down this route knows Pennsylvania laws or could help me a little bit with legal advice. We are going to get a lawyer but if anyone knows what the laws are in PA and would possibly know what he is up against it would help alot!

A first and second time Michigan drunk driving offense are both misdemeanors as well as a “zero tolerance” for underage drinking and driving. A first offense with a minor child in the car is also a misdemeanor. The penalties for OWI (which stands for operating while intoxicated) or the lesser included offense of operating while impaired range from no jail for a zero tolerance violation to 93 days in jail for OWI or OWVI 1st and up to one year for OWI 2nd. A second offense within 7 years carries a mandatory five days in jail.
A second offense with a minor child in the car a third drunk driving conviction within 10 years or a drunk driving accident involving serious injuries or a fatality are felonies. The penalties with these felonies range from as little as 30 days in jail up to 20 years.
Your best bet is to hire an attorney from the National College for DUI Defense if you can afford to do so. At last count there were ten in the state but they are amongst the best drunk driving defense attorneys around.
