I was charged with a DUI in Az of all places the strictest state. Just got my BAC results and it was .05. Why do illegals feel the laws do not apply to them police Impounding Cars of Undocumented Immigrants
Community organizers met with Berkeley city officials on Thursday to discuss concerns about the Berkeley police seizing cars of undocumented immigrants which they said had generated fear among some Latino families.
Julie Sinai chief of staff to Mayor Tom Bates said that although the mayor was aware of the issue and sympathized with the immigrants there was little that could be done since state law authorized the police to tow and impound vehicles for 30 days when driven by drivers who were unlicensed or who had suspended or revoked licenses.
The mayor has been continuously opposed to the state law which says that immigration status is required to get a drivers license she said. But we dont know what local law you could pass that would supersede the state law except for someone actually changing the state law.
At Thursdays meeting Belen Pulido lead organizer for the Berkeley Organizing Congregations for Action asked Jesse Arreguin Berkeleys first Latino councilmember to help the undocumented immigrants whose cars were being seized by Berkeley police at DUI checkpoints or traffic stops.
They are really scared because they feel their cars might be taken away when they are picking up their kids from school or coming home from work Pulido said. And theres no way they can get a license. People are obviously upset Arreguin said adding that he couldnt understand how the police could do this in Berkeley a city of refuge for illegal immigrants. This is a big issue and not in the best interest of the city. Its been going on for a long time and the city has not been doing anything about it. It raises important legal questions and whether we are discriminating against one group of people.
Mark Silverman an attorney for the Immigration Legal Research Center in San Francisco said that the police had been towing cars of undocumented immigrants for a long time in Berkeley but the issue had become a bigger problem in other cities last year where authorities prevented drivers from taking back their seized cars for over a period of 30 days.

Impounding the car of an unlicensed driver is not uncommon. The police in my area will tow your car if you don’t have a license or if you have no insurance.
I love the part’There is no way they can get a license.What should they dogive up driving”…..YESthey are not supposed to be behind the wheel of a car without a valid drivers license. What is so hard to understand about that concept.

Probation violation…whats going to happen
I live in Sacramento California and just received my second dui. I am still on probation from my first dui though. I talked to an attorney who briefly mentioned that he doesn’t recommend I post bail. I don’t totally understand this because I have already been release from jail and did not have any bail. Am I going to be taken into custody for violating probation at my court appearance for my dui Also what will be my sentence for violating probation I have no other prior convictions besides the two duis.
Thank you to everyone who actually helped and not so much to everyone who didnt (most of you). As for the lady who is insinuating that I have a drinking problem….maybe you should go back and read the question because I wasnt asking.
You’ll probably be getting a pretty decent fine lose your license and have to take an alcohol course of some kind. Good luck to you!

I was arrested for DUI in San Francisco
1. Cop gave me temporary drivers license that’s valid for 30 days from the day of arrest
2. My lawyer contacted DMV. DMV said my hearing is in 60 days from the day of arrest.

Worried about DUI Charge

I live in Jacksonville Florida
I take prescription Xanax and I decided to have a glass of wine shortly after because it was St. Patricks day and I just got done eating. Well basically im a cab driver (WAS) I blacked out at the wheel and hit a palm tree. I don’t know if it was exhaustion from being up 3 days strait or what. Well I got 6 months probation loss of lic 6 mo lot of court fines and DUI school etc. Well this happened 3/18/2010. I just got a letter in the mail today stating: Please place the above case on Division F’s calendar for a hearing on Sentence review on April 14th 2010 from the state attorneys office and the judge. Basically I gotta be in court at 10am on APR 14th. Im just worried about *Sentence Review* On the very bottom of the letter it has my name as well as my taxi company manager name and address on it. Im not sure what the hell this means. I have never even picked up my KEYS if I have been drinking I don’t know what the hell I was thinking. I think it was my medicine and sleep deprivation. Does this possibly mean im going to go back to jail I spent 2 days and sentenced me 6 months probation and loss of lic. What do you think this means Im really damn scared. Any input would be much appreciated.

Also does anyone know a website that I can go to and find out what is the problem and why I have to go to court on the 14th I dunno if they are just checking up on me or giving me a harsher sentence since I was a cab driver.
